The Sweepstakes begins Nov 5, 2017 and will end prior to the drawing at the 7PM EDT Dec 12, 2017 EBC Club Meeting at the Coral Gables Congregational Church Chapel 3010 De Soto Boulevard, Coral Gables, Florida 33134.  Online entries via EBC's web site (click on the "Enter Sweepstakes" button above) will be accepted through 4PM EDT Dec 12, 2017.  Entries can also be obtained at the Nov 7, 2017 EBC meeting  and at the December 12 EBC meeting prior to the drawing.

PRIZE: One Specialized Diverge Comp Road Bike, donated by Mack Cycle and Fitness

1.       Introduction: During  the period beginning 5:45 p.m., Eastern Time ("EDT"), Nov 5, 2017,  and ending  at 7:30 p.m, EDT,  December 12, 2017 (the "Sweepstakes Period"),  Everglades Bicycle Club, Inc., a Florida not-for-profit corporation (the “Club”), will conduct a ‘Road Bike’ Sweepstakes (the “Sweepstakes”), which will be governed by these rules, terms and conditions (“Official Rules”).  The Sweepstakes will end, and the winning entry will be drawn and announced, at or shortly after 7:30 p.m. EDT at the monthly Club meeting to be held on December 12,  2017 at or about  that time at, Coral Gables Congregational Church Chapel 3010 De Soto Boulevard, Coral Gables, Florida 33134
2.       Eligibility: The Sweepstakes is open only to residents of one of the 50 United States (or the District of
Columbia) and at least 18 years of age at the time of entry.  The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.

3.       Sponsor: Everglades Bicycle Club., P.O. Box 430282, South Miami, FL 33243-0282, a Florida incorporated not-for-profit sports/social club (the “Sponsor”).  The Sponsor is also the Administrator of the Sweepstakes (the “Administrator”).
4.       Agreement to Official Rules: By participating in the Sweepstakes, each entrant fully, unconditionally and irrevocably agrees to and accepts the Official Rules and the decisions of the Sponsor and Administrator with respect to all matters of rule interpretation, judgment, discretion and otherwise, which are final and binding in all matters related to the Sweepstakes. By the act of entering the Sweepstakes each entrant so agrees to and accepts the Official Rules.
5.       How to by Enter: a. Entry by Computer via Everglades Bicycle Club Website www.evergladesbc.com/roadbikesweepstakes: During the Sweepstakes Period, until December 12, 2017 at 4PM, EDT, an entrant may electronically obtain an entry to be entered into the drawing. (Entries may also be obtained in person at some EBC membership meetings or events, including the EBC membership meeting on 7:00PM, EDT on December 12, 2017).  The minimum donation suggested for each entry ticket is twenty dollars ($20.00).  The minimum suggested donation for a group of six entry tickets is one hundred dollars ($100.00).  Any such donation may be used by the Club for any lawful Club purpose, activity or obligation, and all donations are greatly appreciated.  b. Entry for Mail: During the Sweepstakes Period, and under the rules and procedures described in this paragraph, an entry can be submitted if she  or he (i) hand prints her or his name, address, phone number, email address and age  on a 3" x 5" index card, and (ii) mails it in an envelope with proper postage to "Everglades Bicycle Club Trail Bike Sweepstakes – Free Entry," c/o Everglades Bicycle Club., P.O. Box 430282, South Miami, FL 33243-0282, and (iii) the envelope is postmarked and received by the Administrator by December 2, 2017, which is ten (10) days before the expiration of the Sweepstakes Period. For each mailed-in entry, the entrant can receive no more than one (1) entry for the Sweepstakes (i.e., there is a one-entry limit per envelope) and if the entrant wishes to make more  than one entry, each such entry must be postmarked at least a week apart from each other such entry. All such mail-in entries must be neatly handwritten in ink, and once received will become the exclusive property of Sponsor, and none will be acknowledged as received or will be returned for any reason. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.  Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will be deemed disqualified.
6.       For All Entries:  When seeking to enter, if the participate does not provide a physical address when and where required, or if his or her email address is deemed to be invalid  or not working, Sponsor reserves the right in its sole discretion to invalidate the entry.  All valid entries for the Sweepstakes drawing will be represented by a raffle ticket, and there will be no difference in form or size between a purchased ticket and the ones assigned to free entries.
7.       Drawing: On the drawing date, the Administrator will select the potential winner for the Sweepstakes in a random drawing from all eligible entries received for the Sweepstakes. The winner, if not present at the drawing, will be notified by email, mail or phone.  The winner does not need to be present to win, but the winner will be required to pick up the prize at Mack Cycle.  There will be no shipment of the prize. 
8.       Requirements of Potential Winners: The winner must comply, and have complied, with the Official Rules, and winning is contingent upon fulfilling all requirements and terms of the Official Rules.  The winner will be required to coordinate acceptance of the prize with the Administrator and/or Mack Cycle as instructed at the time the winner is notified.  In the event the winner does not accept the prize within 30 days after receiving notification, Administrator may select an alternate winner in a random drawing from among all remaining eligible entries.
9.       Substitution; Taxes: The Sweepstakes prize consists only of the item described near the top of
these Official Rules. No substitution or exchange for the prize, or assignment or transfer of the prize to another person or entity, may be made by the winner.  Sponsor, however, does reserve the right to substitute for what is described any prize for one of equal or greater value and which reasonably relates to bicycling.  Winners are responsible for all taxes and fees, if any, associated with prize receipt and/or use.

10.   Publicity: Except  where prohibited, participation by each entrant in the Sweepstakes constitutes each such entrant’s consent for the Sponsor, prize providers, and their respective designees to use entrant’s first and last name, likeness, prize information, city and state of residence, and  any comments, testimonials or other feedback related to the prize or entrant's Sweepstakes experience, whether written or oral, for promotional purposes in any media, without further or any consideration or compensation payable to the entrant or any other person or entity.
11.   Additional Terms and Conditions: In  the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to, fraud, human error, virus, or other technical problems, the Sponsor may, in its sole discretion: (a) modify the Sweepstakes in a manner that best conforms to the spirit of the Official Rules without suspending it; or (b) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of the Official Rules; or (c) cancel the Sweepstakes and award the prize in a random drawing from among all eligible entries received up to the time of the impairment.  The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of any part of the Sweepstakes may be a violation of criminal  and/or civil law, and, should such an attempt  be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.  The Sponsor’s failure to enforce any term of the Official Rules shall not constitute a waiver of that term in any manner. 
12.   Release and Limitations of Liability: Except  where prohibited, by participating in the Sweepstakes each entrant agrees to release and hold harmless the Club and its respective parents,  subsidiaries, affiliates, promotional partners, prize partners (including Mack Cycle) and providers, and their  respective agents and agencies, officers and directors (collectively, “Released Parties”), from and against any claim or cause of action arising out of participation in the Sweepstakes, or receipt, use or misuse of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; (e) late, lost, or undeliverable mail or email;  or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt, use or misuse of any prize.  Entrant further agrees that in any cause of action the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, but in no event more than $25.00, and in no event shall the Released Parties be liable for attorneys’ fees or costs.  Entrant knowingly and voluntarily waives the right to claim any damages whatever, including, but not limited to, punitive, consequential, incidental, special, indirect, or direct damages (other than for actual out-of-pocket expenses or statutory damages, subject to the $25.00 maximum amount, unless such maximum is prohibited by applicable law), and waives any and all rights to have damages multiplied or otherwise increased. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible, or if it is not possible and the entrant has paid a donation for the ticket, a refund of what the entrant donated for the ticket.
13.   Disputes: a. Each entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action or other group action, and exclusively by the appropriate state court located in Miami-Dade County, Florida; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Sweepstakes, or statutory damages, subject to the $25.00 maximum unless imposing such maximum is prohibited by applicable law, but in no event attorneys' fees or costs. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of the entrant and Sponsor/Administrator in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of  law rules (whether of the State of Florida or any other jurisdiction), which  would cause the application of the laws of any jurisdiction other than the State of  Florida. b. Notwithstanding any of the foregoing to the contrary described in Section 13.a above, the provisions of this paragraph shall govern and control in all respects.  Before any lawsuit may be instituted to settle any dispute, claim or cause of action, the parties must first agree to discuss it in good faith, either in person or by phone, to see if the matter can be amicably resolved.  If not so resolved within 30 days of the time a party first received notice of the dispute, claim or cause of action, either party may, within 10 days of the end of said 30-day period, require non-binding mediation in Miami-Dade County before a certified mediator or other mediator on whom the parties mutually agree.  If the dispute, claim or cause of action is not resolved by mediation within 90 days following the date a party first notified the other of intent to mediate, then, within 10 days of the end of said 90-day period, either party may elect, as the sole, exclusive and conclusive means of resolving the dispute, claim or cause of action, binding arbitration in Miami-Dade County by, and in accordance with the rules for commercial disputes of, the American Arbitration Association.
